Kerr County and Kendall County started the process for the 391 Commission according to the Daily Times. The commissioners voted 4 to 0 to approve draft documents for an interlocal cooperative agreement, a commission territory map and by-laws. The 391 commission is in response to the multiple battery energy storage systems planned in Kerr County and Kendall County. According to the proposed agreement, the commission would have the authority to “coordinate all efforts with federal and state agencies to reduce the risk which exists to public health, safety and welfare by BESS facility development in Commission Territory.” The newly formed commission would be known as the Hill Country Energy Sub-Regional Planning Commission.
