ERCOT can’t be sued over power grid failures says the Texas Supreme Court. The non-profit corporation qualifies as a sovereign entity which protects it from lawsuits. Chief Justice Nathan Hecht wrote in the majority opinion that ERCOT qualifies for immunity because it “provides an essential governmental service”.
